2. Acceptance of Terms and Conditions

By participating in the August 2026 Win Your Course Fees Back Promotion (“Promotion”), entrants agree to be bound by these Terms and Conditions. The Promotion is a game of chance. Skill plays no part in determining the winner.

3. Promotional Period

The Promotion commences at 12:01am AEST on Friday 14th August 2026 and closes at 11:59pm AEST on Monday 31st August 2026 (“Promotional Period”). All dates and times in these Terms and Conditions are Australian Eastern Standard Time (“AEST”). Entries received outside the Promotional Period will not be accepted.

4. Eligible Entrants

Entry is open to individuals who:
1. Are aged 18 years or over;
2. Reside in Australia, excluding the Australian Capital Territory;
3. Remain based in Australia, excluding the Australian Capital Territory, while undertaking their eligible course;
4. Enrol as a new Fitness Institute student during the Promotional Period; and
5. Satisfy all other requirements contained in these Terms and Conditions.

The Promotion is not open to residents of the Australian Capital Territory. Australian citizenship is not required. However, an entrant must provide an eligible Australian residential address.

For the purposes of this Promotion, a “new Fitness Institute student” is a person who had not completed an enrolment in a Fitness Institute course before the commencement of the Promotional Period.

Directors, officers and employees of the Promoter, its related entities and any agencies directly associated with the Promotion, and their immediate family members, are not eligible to enter.

“Immediate family member” means a spouse, former spouse, de facto partner, child, parent, grandparent, grandchild or sibling, whether natural, step or adopted.

5. Eligible Courses

The Promotion applies to new students enrolling during the Promotional Period in one of the following Fitness Institute products:

● SIS30321 Certificate III in Fitness – Online;
● SIS40221 Certificate IV in Fitness – Online;
● SIS30321 Certificate III in Fitness – 8-week Face-to-Face;
● SIS40221 Certificate IV in Fitness – 8-week Face-to-Face; or
● An eligible combined SIS30321 Certificate III in Fitness and SIS40221 Certificate IV in Fitness package offered by Fitness Institute.

The relevant course or package must be open and available for enrolment during the Promotional Period.

Short courses, continuing professional development courses, mentoring products, course extensions and any products not expressly listed above are excluded.

6. How to Enter

To enter the Promotion, an eligible entrant must, during the Promotional Period:

1. Complete their first enrolment with Fitness Institute in an eligible course;
2. Complete and submit all required enrolment documentation;
3. Accept the applicable Fitness Institute Terms and Conditions of Enrolment;
4. Provide all information required to process the enrolment;
5. Make the initial payment required under their enrolment agreement; and
6. Have their enrolment accepted and processed by Fitness Institute.

Eligible entrants will be entered automatically into the Promotion. No separate competition entry form is required. There is no entry fee beyond the ordinary fees payable under the entrant’s enrolment agreement. Course prices will not be increased because of the opportunity to participate in the Promotion.

7. Cooling-Off Period and Enrolment Status

An entrant must remain actively enrolled and must not have cancelled or withdrawn from their enrolment at the time of the draw. If an entrant’s applicable cooling-off period has not expired by the draw date, the entrant may participate in the draw. However, any prize awarded to that entrant will remain provisional until their cooling-off period has expired. If a provisional winner cancels or withdraws from their enrolment during the applicable cooling-off period, their entry will be declared invalid and the prize will be awarded in accordance with clause 17.

An entrant must be financially up to date with all payments due under their enrolment agreement when their eligibility is verified and the prize is awarded.

8. Entry Limits

Each eligible entrant will receive a maximum of one entry into the Promotion. A student who enrols in a combined Certificate III and Certificate IV package will receive one entry, not one entry for each qualification.

An entrant cannot receive additional entries by:

● Enrolling in additional courses;
● Making additional payments;
● Submitting duplicate enrolments; or
● Enrolling in a combined course package.

Entries in this Promotion do not transfer or roll over into any other promotion.

9. Validation of Entries

The Promoter reserves the right to verify an entrant’s:

● Identity;
● Age;
● Australian residential address;
● Enrolment documentation;
● Course or product selection;
● Payment status;
● Cooling-off status; and
● Compliance with these Terms and Conditions.

Entrants must provide any information reasonably requested by the Promoter for verification purposes. An entry may be declared invalid if it is incomplete, fraudulent, duplicated, submitted using false or misleading information or otherwise fails to comply with these Terms and Conditions. If an entrant is unable to provide satisfactory evidence of eligibility, their entry may be declared invalid and any provisional prize entitlement forfeited.

10. Prize

There is one prize available in the Promotion. The prize consists of reimbursement or credit of the winner’s eligible base course tuition fees. The value of the prize will equal the actual base course tuition fee paid or payable by the winner for the eligible Fitness Institute product in which they enrolled, capped at the lower of:

1. The standard base course fee for that product at the time of enrolment;
2. The actual base course tuition fee payable under the winner’s enrolment agreement; or
3. AUD $4,500.

The maximum total prize value for the Promotion is AUD $4,500. If the winner enrolled at a discounted or promotional price, the prize will not exceed the actual base course tuition fee payable under the winner’s enrolment agreement. If the eligible base course tuition fee is less than AUD $4,500, the winner will not receive the difference between the eligible tuition fee and the maximum prize value.

11. Application of the Prize

If the winner has paid all eligible base course tuition directly to the Promoter, the eligible amount will be reimbursed. If the winner has paid part of their eligible base course tuition and has an outstanding eligible tuition balance with the Promoter, the prize will first be applied as a credit against that balance. Any remaining prize entitlement will then be reimbursed up to the amount of eligible base course tuition already paid. If the winner uses an approved payment plan or external finance arrangement, the Promoter will determine the appropriate method of applying the prize, having regard to the terms of that arrangement and applicable law. Any reimbursement will normally be made to the original payer or original payment method. The Promoter may require proof of payment, identity or bank-account ownership before processing a reimbursement.

The prize does not include:

● Course extension fees;
● Reassessment or resubmission fees;
● Replacement learning resources;
● Equipment, uniforms or optional products;
● External finance charges or interest;
● Third-party charges;
● Merchant or payment-processing fees;
● Late payment, dishonour or administration fees;
● Any amount previously refunded, credited or waived; or
● Any charge that does not form part of the eligible base course tuition fee.

Where Certificate III and Certificate IV were purchased as a combined product, that product will be treated as one eligible enrolment and the total prize will remain capped at AUD $4,500.

12. Prize Conditions

The prize:

● Is personal to the winner;
● Is not transferable to another person or student;
● Cannot be transferred to another course or product without the Promoter’s written approval;
● Cannot exceed the eligible base course tuition paid or payable by the winner;
● Cannot be exchanged for another prize; and
● Cannot result in an additional cash payment beyond reimbursement of eligible base course tuition already paid by the winner. Winning the prize does not remove the winner’s obligation to participate in their course or comply with their student enrolment agreement and applicable Fitness Institute policies.

Normal course withdrawal, cancellation and refund conditions continue to apply. The winner will not be entitled to receive any refund, credit or financial benefit that would result in the winner receiving more than the eligible base course tuition they paid or were required to pay. Any tax implications arising from acceptance of the prize are the responsibility of the winner. Entrants should obtain independent financial or taxation advice where appropriate.

13. Draw

The draw will take place at 12:00pm AEST on Thursday 3rd September 2026 at the Promoter’s administrative office in Queensland. The winner will be selected at random from all valid entries received during the Promotional Period using a computerised random-number generator. Each valid entry will have an equal chance of winning. The first valid entry selected will be the provisional winner, subject to verification by the Promoter. The Promoter may also select reserve entries in case the provisional winner is found to be ineligible or does not comply with these Terms and Conditions. The draw will be conducted under the supervision of an authorised representative of the Promoter
and in accordance with applicable legal requirements. Entrants are not required to be present at the draw.

14. Winner Notification

The provisional winner will be notified by email using the email address recorded in their Fitness Institute enrolment. The notification email will be sent within seven days of the draw. The Promoter will make reasonable attempts to contact and verify the provisional winner. The provisional winner must respond to the notification email and provide any information reasonably requested by the Promoter to verify their eligibility and claim the prize.

The provisional winner will not become the confirmed winner until:

1. Their eligibility has been verified;
2. They have complied with these Terms and Conditions; and
3. Their applicable cooling-off period has expired without the enrolment being cancelled or withdrawn.

15. Publication of the Winner

Subject to applicable law, the verified winner’s first name, surname initial and state or territory will be published on:

● The Fitness Institute website at https://fitnessinstitute.com.au; and
● Fitness Institute’s official social media channels.

The winner’s details will be published within 30 days of the draw. Any additional information, including the winner’s full name, photograph, testimonial, course information or video, will only be published with the winner’s consent.

16. Claiming and Receiving the Prize

The prize must be claimed within two months of the draw date by responding to the winner-notification email. Once the winner has been verified, the Promoter will apply the tuition credit or arrange any eligible reimbursement as soon as reasonably practicable, ordinarily within 30 days. The winner must provide accurate information reasonably required to process the prize. If the winner does not provide the requested information, cannot be verified or does not claim the prize within the required period, the prize may be forfeited, subject to applicable law.

17. Invalid or Unclaimed Prize

If the provisional winner is found to be ineligible before the prize is awarded, the Promoter may award the prize to the first eligible reserve entry selected during the original draw. If no eligible reserve entry is available, or if the prize remains unclaimed for two months after the original draw, an unclaimed prize draw will be conducted at 12:00pm AEST on Wednesday 4th November 2026 at the Promoter’s administrative office in Queensland. The unclaimed prize winner will be selected at random from the remaining valid entries using a
computerised random-number generator. The unclaimed prize winner will be notified and published in the same manner as the original winner. If the prize has been validly claimed and awarded, the unclaimed prize draw will not be conducted.

18. Privacy

The Promoter collects personal information to administer the Promotion, verify entries, contact the winner, award the prize and comply with legal and regulatory obligations. Personal information will be handled in accordance with the Fitness Institute Privacy Policy, available at: https://fitnessinstitute.com.au/privacy/

The Promoter may disclose personal information to its employees, contractors, professional advisers, service providers, payment providers and government regulators where reasonably necessary to conduct the Promotion or comply with the law. If the Promoter cannot collect the information reasonably required to administer an entry, the entrant may be unable to participate in the Promotion or receive the prize.

Participation in the Promotion does not, by itself, constitute consent to receive marketing communications beyond any consent separately provided by the entrant.

19. Publicity

The winner may be invited to participate in reasonable promotional activity relating to the Promotion, including photographs, interviews, testimonials and social media content. Participation in additional promotional activity is voluntary and subject to the winner’s consent. Refusal to participate in additional promotional activity will not invalidate an otherwise valid prize entitlement.

20. Course and Career Representations

The Promotion does not guarantee:

● Admission to a course;
● Successful completion of a course;
● The issue of a qualification;
● Professional registration;
● Employment;
● Income; or
● Any particular career outcome.

All enrolments remain subject to the applicable course entry requirements, student enrolment agreement, Fitness Institute policies and course availability.

21. Technical Problems and Disruption

If any aspect of the Promotion cannot operate as planned because of fraud, tampering, unauthorised intervention, technical failure, computer virus, communications failure or another cause beyond the Promoter’s reasonable control, the Promoter may suspend, modify, terminate or cancel the Promotion, subject to applicable laws and any required regulatory approval. The Promoter will not cancel or modify the Promotion in a manner that unfairly disadvantages existing eligible entrants, except where reasonably necessary or required by law.

22. Liability

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

To the extent permitted by law, the Promoter is not responsible for:

● Entries that are late, lost, incomplete, incorrectly submitted or misdirected;
● Technical or communications failures outside the Promoter’s reasonable control;
● Incorrect contact or enrolment information supplied by an entrant; or
● The winner’s failure to receive a notification because of spam filters, email settings or outdated contact details.

Entrants are responsible for ensuring that their contact information remains accurate and current.

23. Decisions and Disputes

The Promoter’s decisions concerning entry validation, eligibility, the draw and prize administration are final, subject to applicable law.

The Promoter will consider complaints in good faith and in accordance with applicable law. Nothing in these Terms and Conditions limits an entrant’s right to contact an applicable consumer protection, education or gaming regulator.

24. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Entrants submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts. Nothing in this clause excludes the application of laws in another eligible Australian State or Territory that cannot lawfully be excluded.

25. Availability of Terms and Conditions

These Terms and Conditions will be available on the Fitness Institute website throughout the Promotional Period. The Promoter will retain a copy of these Terms and Conditions and records relating to the draw and prize award for its administrative and compliance purposes.
